Terms of Service

1. Eligibility

You must be at least 13 years old to use SneakerPing. If you are under 18, you may only use the Service with the consent of a parent or legal guardian. By using the Service, you confirm that you meet these requirements.

2. Our Service

SneakerPing provides tools for sneaker enthusiasts, collectors, and resellers, including:

• Real-time alerts when sneaker prices change across supported marketplaces
• Price tracking and notification tools
• Optional integrations with third-party platforms (e.g., StockX, GOAT, eBay, Discord)
• Account login options via Google and Discord

We may update, modify, or discontinue features at any time.

3. Accounts

When you create an account, you agree to:

• Provide accurate information
• Keep your login credentials secure
• Not share your account with others

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Payments & Subscriptions

• Payments are processed securely through Stripe.
• You agree to pay all fees and applicable taxes associated with your use of paid features.
• Subscriptions automatically renew unless canceled before the renewal date.
• You may cancel at any time in your account settings; cancellations take effect at the end of your billing cycle.
• All sales are final unless otherwise required by law.

5. Refund & Cancellation Policy

We want you to have confidence in your subscription. Our policy is:

• Cancellations: You can cancel your subscription at any time through your account settings. Once canceled, your subscription will remain active until the end of the current billing cycle, after which it will not renew.
• Refunds: As SneakerPing is a digital service with immediate value provided, all payments are non-refundable. Exceptions may be made only if required by applicable law (for example, certain jurisdictions may allow a short "cooling-off" period).
• Billing Issues: If you believe you were charged in error, please contact us within 14 days of the charge. We will review your case and issue a correction or refund if appropriate.
• Free Trials: If we offer free trials, you will not be charged until the trial ends. You may cancel before the trial period ends to avoid charges.

6. Acceptable Use

You agree not to:

• Use SneakerPing for illegal or fraudulent purposes
• Attempt to scrape, reverse-engineer, or overload our systems
• Circumvent subscription or usage limits
• Interfere with other users' use of the Service

7. Third-Party Services

SneakerPing integrates with and relies on third-party services, including but not limited to:

• Stripe & Stripe Radar (payment processing and fraud prevention)
• Supabase (database management)
• Vercel (hosting)
• Google Analytics (analytics tracking)
• Google & Discord Sign-In (authentication)
• Twilio (SMS messaging)
• Resend (transactional email)
• Kit.com (newsletters and marketing email)
• Google Ads, Meta Ads, TikTok Ads pixels (advertising and measurement tools)

By using SneakerPing, you also agree to the terms and privacy practices of these third-party services.

8. Intellectual Property

All content, branding, and software provided through SneakerPing are owned by Clutch Digital LLC or our licensors. You may not copy, modify, distribute, or create derivative works without our prior written consent.

9. Disclaimer of Warranties

SneakerPing is provided "as is" and "as available." We make no guarantees that the Service will always be available, accurate, or error-free. We are not responsible for missed sneaker drops, marketplace changes, or any financial losses resulting from your use of the Service.

10. Limitation of Liability

To the maximum extent permitted by law, Clutch Digital LLC and its officers, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, or business opportunities.

11. Termination

We may suspend or terminate your account at any time if you violate these Terms. You may also stop using the Service at any time.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will post the updated version with a new "Effective Date." Continued use of SneakerPing after changes means you accept the new Terms.

13. Governing Law

These Terms are governed by the laws of the United States and the State of Oregon, without regard to conflict of law principles.
